General Terms and Conditions of Sale and Use (CGU/CGV)

1. Service Description

Kalibrant provides an application designed to assist users in identifying potential cybersecurity threats, specifically phishing attempts, via automated threat intelligence analysis and, for premium tiers, human expert guidance. The Application is published by Kalibrant Consulting.

2. User Accounts and Security

To use certain features, you must register for an account. You are responsible for safeguarding your password and any cryptographic keys generated by the Application (including your 'Private Key' used for End-to-End Encryption). Kalibrant cannot recover lost Private Keys. You agree not to disclose your password or Private Key to any third party and to take sole responsibility for any activities or actions under your account.

3. Subscriptions (CGV)

Kalibrant offers premium subscription tiers ("Protection" and "Serenity") via in-app purchases.

• Billing: Payments are processed entirely by the Apple App Store or Google Play Store. Kalibrant does not collect or store your credit card information.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your device's account settings. Cancellations apply to the next billing cycle; we do not provide refunds for partial months.

4. Intellectual Property

The Service and its original content, features, functionalities, and analytical logic are and will remain the exclusive property of Kalibrant Consulting and its licensors. The Service is protected by copyright, trademark, and other laws.

Please note: Our "Double Shield" privacy feature combines industry-standard anonymization and encryption. We implemented this robust combination specifically for your protection, but we do not claim proprietary invention or ownership over these underlying fundamental concepts.

5. Acceptable Use and Restrictions

You agree not to use the Application:

• In any way that violates any applicable national or international law or regulation.
• For the purpose of exploiting, harming, or stalking individuals without their explicit consent.
• To transmit any material which is defamatory, offensive, or otherwise objectionable in the context of the Serenity Chat.
• To reverse engineer, decompile, or disassemble any aspect of the Application or its proprietary threat intelligence logic.

Kalibrant reserves the right to terminate or suspend your account immediately, without prior notice or liability, for conduct that we determine, in our sole discretion, violates these Terms.

6. No Warranty and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Kalibrant provides advisory risk assessments based on statistical probabilities and known threat signatures. We do not guarantee 100% protection against cyber threats, data breaches, or financial loss.

In no event shall Kalibrant Consulting, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any advice followed or ignored from the Serenity Chat experts; or (iv) unauthorized access, use or alteration of your transmissions or content.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts of France.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
